22, 2010, Judge Patricia Joyce heard the revised report of the Special
Master,
James T. LePage, Ph.D. She heard testimony from Brian Kinkaide
of the Department
of Social Services. She took the matter of the
damages--the underpayment to the
class under submission, which means that she
will consider the evidence and legal
principles and then rule.
Judge Joyce
indicated that she would issue a judgment before April 19, 2010, which
is the
date she set for the next telephone conference. The attorneys for the
class
do expect that the Department of Social Services will appeal any
judgment adverse
to the Department's interest. The attorneys have been
asked to prepare some documents
for the Court and they are doing so.
We
will keep you informed of any decision made by the Court in this
matter.
______________________________________________________
I hope that
this helps. Thanks, Debbie Greider
Deborah S. Greider
Parkway Tower,
