Among the bill’s provisions would be to change the standard of proof for claims of
discrimination.   The discrimination would have to be a motivating factor, rather
than just a contributing factor in order for an action taken by an employer to be
considered unlawful.  The bill also would exempt persons acting in the interest of
employers from liability for discrimination.  The bill also would limit the amount
of damages for employment discrimination cases to a maximum of $300,000 for employers
with more than 500 employees.  The damage cap would be lower for smaller employers.
